• Use automated tools, bots, scrapers, or crawlers to access the Platform in a manner that places an unreasonable burden on our infrastructure
• Introduce viruses, trojans, malware, or any other malicious code into the Platform
• Use the Platform in any way that violates applicable federal, state, or local law
• Engage in any conduct that restricts or inhibits any other user’s enjoyment of the Platform

Violation of this Acceptable Use Policy may result in immediate termination of your access to the Platform and may be reported to relevant law enforcement authorities.

When you submit a loan inquiry and are connected to a lender, you will be subject to that lender’s own terms, conditions, and privacy policy. Business Loans IQ is not a party to any loan agreement between you and a lender and accepts no responsibility for the lender’s conduct, the terms of any loan offered, or any outcome of a lending relationship.

We do not guarantee that any particular lender will approve your application or offer you financing on any specific terms.

9. Intellectual Property

All content on the Platform, including but not limited to text, articles, guides, rankings, comparison tools, graphics, logos, icons, images, and the compilation and arrangement of content, is the exclusive property of Business Loans IQ or its content licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content or information available through the Platform.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BUSINESS LOANS IQ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF BUSINESS, LOSS OF DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ACCESS THE PLATFORM IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability, so some of the above limitations may not apply to you.

13. Indemnification

14. Termination

We reserve the right to suspend or terminate your access to the Platform at any time and for any reason, including but not limited to violation of these Terms of Use, suspected fraud, or conduct we determine to be harmful to other users or to our business, without prior notice or liability.

Upon termination, your right to use the Platform will immediately cease. Sections of these Terms that by their nature should survive termination, including the disclaimers, limitation of liability, indemnification, and governing law provisions, will continue to apply.

15. Governing Law and Dispute Resolution

These Terms of Use are governed by and construed in accordance with the laws of the United States and the state in which Business Loans IQ maintains its principal place of business, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms of Use or your use of the Platform that cannot be resolved through good-faith negotiation shall be resolved through binding arbitration administered under the rules of the American Arbitration Association, rather than in court, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction for matters involving intellectual property infringement.

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If applicable law prohibits class action waivers with respect to a particular claim, that claim will proceed in court but all other claims will proceed in arbitration.

16. Changes to These Terms

We reserve the right to modify these Terms of Use at any time. When we make material changes, we will update the “Last Updated” date at the top of this page and, where appropriate, notify registered users by email.

Your continued use of the Platform after any changes to these Terms constitutes your acceptance of the revised Terms of Use. If you do not agree with any changes, you must stop using the Platform.
